Well, I guess that's somewhat my point. I don't know and have never
dealt with "Wayne" but I give everybody the first benefit of the doubt.
Even someone who advertises "in business for over 25 years" and with a d/b/a
like "Triumphs Only" could have be fooled by a really good fake, but once he
knew it to be a fake didn't he have an affirmative obligation to mention
that the second time around? And with it being a particularly rare item,
didn't that make the obligation to disclose even more pressing? I passed no
judgment on the man as a result of the first offering, but not disclosing
AFTER knowing is the cardinal sin. He might not have created the fake, but
he certainly seems willing to perpetuate it!
