must be some muffler that is adequate.  Not having  one is not the intention

Again, what "is" a muffler? Is it function or a specific part? The way the  
rules are written, it is the functional "muffling", to create acceptable sound  
levels, as far as I can tell. Whether there is a metal enclosure with a sound 
 absorbing material in the equation is not relevant...as long as the sound  
emanating from the exhaust is muffled aka meets the sound  requirement.
