That's not entirely true -- the SM rules do require vehicles to be legally
registered for street use. In some places, that mandates retaining the cat,
because you can't get a registration without it. In others, you can. IIRC,
this was a big discussion topic when developing the SM proposal, and the
concensus was that with varying inspection and registration requirements
across the country (not to mention the Great White North), the only
reasonable, enforceable standard would be the registration.
