It was a while back, but the MoHud Region of SCCA had a NYS trooper in
to give us a presentation on this and similar subjects a few years
ago. He was very forthright in his descriptions, and said 'Essentially
if you are transporting something and are getting paid to transport it
by a third party (more than just gas money) you are a commercial
carrier and should go through all the associated legalities." He
further went on to say that hauling a race car to/from the track where
it is leased or rented out would also not count as commercial.'
He further went on to say that, however, if you are hauling fuel and
the like (compressed gasses etc) in your trailer, you are 'in
general', because you are not commercial, you are not required to have
permits, special license endorsements or placards. But that the NYSP
and the fire departments sure would look on a placard as helpful.
It was a great presentation in which he pretty much summed up how to
relate to being pulled over as 'if what you are doing is legal,
(unsaid was "or mostly so"), you're polite and not a jerk, you'll be
all set. Cops generally don't give you a hard time if you don't
deserve it.' And if they do give you a hard time, go see the judge.
They know which guys are jerks and love to smack them down.
