So, are you saying that it is MY fault for having idiots that are DAs? I'm
not being facetious here, I am really asking. If that is the case, I will
pay a lot more attention to the next DA race.
I couldn't agree more that ours is the best legal system available at this
time. However, I'm still not convinced that the reason a lot of defense
attorneys are viewed in a less than favorable light is because they delight
in getting the obvious one's off on, yes, a technicality. I really feel that
common sense needs to have a place in the courtroom. And if someone that is
obviously stealing someone else's property gets cut and then turns around
and sues the person protecting that property, and WINS, there is something
wrong.
However, I'm done. I didn't sign up for this list to discuss politics or
lawyers or anything else except Triumphs. I let you guys go on from here.
But I still think the darning needles was a great reward for someone stupid
enough to try to steal someone else's property.

It is NOT the role of the defense lawyer to seek justice. That is
the role
of the DA and the Judge. Most DA's have long ago forgotten that.
It IS the
role of the defense lawyer to make the state prove its case beyond a
reasonable doubt. It IS the defense lawyers job to make the police
follow
the law and to exclude illegally obtained evidence. It IS the
defense
lawyers job to see the Constitution is not regarded as a mere
technicality
and is honored as the highest law and foundation of fairness,
justice and
control of the power of the state. It is the job of the state to
prove its
case through lawful means or else LOSE! Finally, its the job of the
police
to act like professionals and solve cases through police work that
produces
competent evidence and not act like a bunch of idiots who need to
lie and
cheat to get a conviction.
