If you used your credit card, call your credit card company and ask them
to mail you a form for a complaint and send the merchandise back with some
sort of a receipt for delivery. I think it comes as a default with UPS.
Your credit card company won't give him the money and you won't have to
pay.
Credit cards are a great protection when buying mail order. In fact, my
ATT card is not only free if you use it once a year, but it DOUBLES the
warranty for up to an additionaly year on everything you buy with it. Many
of the other premium cards do this as well.
