Actually from what I can remember of the ruling, it looked as tho the fact that
the BMW hardtops they used were totally unavailable
to anyone in the US at the time was more of a factor in the DQ.

I'm surprised no one has mentioned the big Z4/SSB fiasco from this year.
One of the major reasons they were deemed not legal was the inavailablity of
FSM which BMW does NOT sell to the public - at least according to official
BMW statements.
